DUTIES

AdeleD Photography agrees to carry out the Photo Session with diligence, punctuality, and in full compliance with this Agreement. AdeleD Photography will perform the session professionally, following industry standards and best practices typical of well-managed photography.

The Client may not take any personal photographs during the Photo Session.

PRICING

Prices are subject to change without prior notice and are not open to negotiation. Due to the personalised nature of photographic products, all sales are final and non-refundable.

PAYMENT

Payment must be made within 48 hours of confirming the session date. This payment secures your booking. Please note that photo sessions will NOT proceed unless payment has been received in full.

All outstanding balances must be settled before any orders are sent for printing.

The amounts are payable into the bank account of AdeleD Photography

AdeleD Photography holds the copyright to all images produced during the Photo Session and may use any of these photographs for purposes such as, but not limited to, advertising, showcasing in a portfolio, promotional materials, sample displays, editorial content, website use, or display within or outside AdeleD Photography's Studio.

THE CLIENT'S USAGE

The Client acknowledges and agrees to use the professional photos for personal or commercial purposes in accordance with the following terms. The Client is authorized to utilize the images across various platforms, including, but not limited to, websites, social media, digital advertisements, email campaigns, promotional videos, and personal enjoyment. The Client may also incorporate the images into printed materials such as brochures, flyers, product packaging, and press releases.

Unless otherwise agreed upon, all rights to the images remain with AdeleD Photography. The Client agrees not to alter, distribute, resell, or reproduce the images for profit, nor to use them in any way that may harm AdeleD Photography's reputation or violate intellectual property laws.

FAILURE TO PERFORM

Should AdeleD Photography is unable to perform the Photo Session on the agreed date due to circumstances beyond their control or due to illness, they will make reasonable efforts to reschedule the session at a mutually convenient time, subject to their availability. If rescheduling is not possible, AdeleD Photography will refund the Client’s deposit and will have no further obligations under this Agreement.

INDEMNITY

The Client agrees to release and hold AdeleD Photography harmless from any and all claims, demands, liabilities, losses, or damages—including those arising from personal injury or property damage (including to individuals or property accompanying the Client)—that may result from participation in portrait or commercial photography sessions. This includes claims brought by third parties or imposed by a court of law, and applies to any acts, omissions, negligence, or misconduct by AdeleD Photography. The Client also agrees to indemnify and reimburse AdeleD Photography for any legal expenses incurred, including but not limited to attorney’s fees, fines, penalties, and related costs.

CANCELLATIONS & POSTPONEMENTS

Cancellation within 24 hours: If the client cancels the photo session within 24 hours of the scheduled appointment (date and time), the entire deposit is forfeited.
Cancellation between 1 to 5 days before the appointment: If the session is cancelled within 5 days but more than 24 hours before the appointment, an administrative fee of 60% will be deducted from any refund owed to the client.
Postponement within 5 days of the appointment: If the session is postponed within 5 days of the appointment date, an admin fee of 50% will be charged.

FAILURE TO APPEAR

If the Client does not appear at the scheduled date and time of the Photo Session and has not rescheduled the appointment in accordance with the terms outlined in the 'Cancellations & Postponements' clause, the Client shall forfeit the full deposit.

FINAL IMAGES

AdeleD Photography will inform the Client once the final image retouching is complete.

If needed, a ‘Reveal and Ordering Session’ will be scheduled at AdeleD Photography's Studio. All individuals involved in making decisions regarding the photos and finances should be present.

Under no circumstances will AdeleD Photography provide RAW or unedited images to the Client. AdeleD Photography will carefully select and process the best images for delivery.
